How to use the court fee calculator

This digital calculator is designed to provide a quick estimate of the court fees payable for claims and applications filed with Romanian courts, under Government Emergency Ordinance No. 80/2013 (GEO 80/2013). It calculates the first-instance court fee and estimates the fees for appeals and appeals on points of law, covering claims with or without a monetary value, special procedures and statutory exemptions.

  • 1. Select the procedural category: From the first list, choose the general category of your application (for example, pecuniary claims, partition, enforcement, family matters, administrative litigation or applications during proceedings).
  • 2. Select the specific type of claim: Depending on the chosen category, select the specific subject matter from the second list (for example, a payment order, eviction, small claim, challenge to enforcement or possessory claim).
  • 3. Enter the value or quantity, if applicable: For pecuniary claims, enter the value of the claim in RON (or the value of the property to be divided / debt challenged). For other specific applications, enter the requested number (such as pages for copies, persons whose recusal is requested or enforceable instruments).
  • 4. Click ‘Calculate fee’: The application immediately displays the first-instance fee, estimated appeal and appeal-on-points-of-law fees where applicable, and useful legal notes on the procedure.

Progressive fee scale (Article 3 of GEO 80/2013): For pecuniary claims, the fee is calculated in value bands with decreasing percentage rates, starting at 8% for smaller amounts and reaching a fixed sum plus 1% of the amount exceeding RON 250,000.
Appeal fees: As a general rule, an appeal is charged at 50% of the first-instance fee, subject to a minimum of RON 20, while an appeal on points of law is charged at RON 100 for claims without a monetary value or 50% of the first-instance fee for pecuniary claims.
Special statutory exemptions (Article 29 of GEO 80/2013): Certain categories of claims are fully exempt from court fees at all procedural stages (for example, maintenance claims, employment disputes, social insurance rights, consumer protection, protection orders and divorce/partition claims brought by victims of domestic violence).
Payment obligation and consequences of non-payment: Court fees are paid in advance or within the period specified by the court in the summons. Failure to pay the fee, or payment of an insufficient amount, leads to annulment of the statement of claim.
Refund of court fees: In the cases provided by law (for example, where a settlement removes the subject matter of the claim, the claimant withdraws before service of the claim, or an excessive amount was paid by mistake), the fee may be refunded in whole or in part at the interested party’s request.
