Opposition to trademark registration at OSIM or EUIPO
Opposition allows an earlier-right holder to challenge a new trademark registration on relative grounds before it becomes established. OSIM’s deadline is two months from publication of acceptance; EUIPO’s opposition period is three months from publication of the application. Timetables and grounds are not interchangeable.
Opposition is not a comparison of logos
Analysis considers the signs’ overall impression, distinctive and dominant elements, similarity of goods or services and the relevant public. Phonetic comparison may be decisive despite different graphics, while a shared descriptive element may carry little weight.
Invoked earlier rights must be valid and confer standing for the relevant territory. Opposition is not the appropriate procedure for every absolute ground or commercial grievance.
The opponent’s case and applicant’s response
The position must rest on the exact goods list, earlier-right documents and verifiable evidence. Applicants may challenge similarity, the right’s scope and, where conditions are met, genuine use of the earlier mark.
- Signs: representation, pronunciation, meaning and distinctive elements.
- Goods: nature, purpose, channels, complementarity and public.
- Earlier right: owner, territory, status and scope.
- Use: invoices, advertising, packaging, sales and relevant period.
- Reputation: evidence of brand awareness, not mere assertions.
- Remedy: refusal in full or only for certain goods and services.
Negotiation during proceedings
Parties may negotiate a narrower list, changes to commercial presentation or a coexistence agreement. EUIPO’s cooling-off period is specifically designed to allow settlement before the full adversarial stage.
The agreement must resolve the actual conflict, not just the current opposition. Territories, channels, trademark variants, future expansion and incident-resolution mechanisms require sufficient precision.
The decision and next steps
The decision may uphold or dismiss opposition wholly or partly. Remedies, deadlines and costs differ between OSIM and EUIPO, and a challenge’s merits depend on the reasoning and commercial value of the affected list.
Invalidity, revocation or infringement actions may remain possible after proceedings end. Brand strategy should also include actual use, monitoring later applications and retaining evidence.

Can I oppose merely because the name is similar?+
An earlier right and a statutory relative ground are required. Similarity is assessed alongside goods, services and the relevant public.
What if my earlier trademark has not been used?+
Once the relevant period expires, lack of genuine-use evidence may affect opposition. Analysis depends on the right’s date and territory.
Can opposition block only part of an application?+
Yes. If the conflict concerns only certain goods or services, the application may continue for the rest, depending on the decision or negotiated restriction.
