How to use the child maintenance calculator
This digital calculator provides a quick estimate of child maintenance payable by a parent, using the statutory proportions in Article 529 of the Civil Code. It estimates an indicative maximum monthly amount by reference to the paying parent’s net income, the number of children covered by the claim and any other dependent children of the same parent.
- 1. Enter monthly net income: Enter the paying parent’s net income. If no income is known or declared, leave the field blank or enter
0(the calculator will automatically use the reference national net minimum wage). - 2. Select the number of children covered by the claim: Choose the number of children for whom maintenance is sought or an increase requested in these proceedings (1, 2, or 3 and more).
- 3. Specify other dependent children: Select whether the paying parent has other children from other marriages or relationships. Their existence affects each child’s share so that the statutory maximum limits are respected.
- 4. Reference net minimum wage: Check or update the reference national net minimum wage (default: RON 2,363), used by the calculator where no official income is entered.
- 5. Click ‘Calculate child maintenance’: The result displays an estimated monthly total, the percentage applied, a breakdown per child and relevant legal notes.
Statutory maximum proportions (Article 529 of the Civil Code): The calculation starts from the statutory maximums: up to 1/4 (25%) of net income for 1 child, up to 1/3 (33.33%) for 2 children and up to 1/2 (50%) for 3 or more children.
Overall 50% ceiling: Regardless of the total number of children, combined maintenance obligations cannot exceed half (50%) of the parent’s monthly net income.
Income with a continuing character: The assessment generally considers continuing income, such as salary, recurring bonuses, dividends, rent and pensions. Occasional receipts, travel allowances and benefits earmarked for a specific purpose require separate assessment rather than automatic inclusion.
The child’s actual needs: The statutory proportion is a theoretical maximum. The court may set a fixed monthly amount adapted to the child’s specific needs and the parent’s actual means.
Exceptional income: Where the paying parent has very high income, courts may set an appropriate amount covering the child’s actual upbringing and educational needs.
