Contractual liability is assessed under Article 1350 of the Civil Code and non-contractual liability under Article 1357 et seq., depending on the obligation breached. Failure to honour self-exclusion does not mean automatic repayment of all losses. Breaches of self-exclusion, withheld winnings and court proceedings

We preserve the self-exclusion request, registration confirmations, participation history, deposits, withdrawals and correspondence with the operator. Under Article 8(6) of the 2025 ONJN Procedure, the exclusion becomes enforceable against the operator after a calendar day has elapsed, beginning at 00:00 on the day following entry in the ONJN database; simply sending the request must not be confused with that point in time. We examine the actual rules governing the operator and participation, including any special rules for remote gambling. Reporting the matter to ONJN may trigger administrative investigations but does not itself award civil compensation. In court, we specify the breach, the legal basis and the justified amount claimed, including unpaid winnings. We do not present cancellation of all transactions or full recovery of losses as guaranteed consequences.
