Financial exploitation of a vulnerable person

Legal defence in cases involving financial exploitation of a vulnerable person

Financial exploitation of a vulnerable person (Article 247 of the Criminal Code) has two forms. When granting a loan, a creditor takes advantage of the debtor’s obvious vulnerability caused by age, health, disability or dependence to obtain for themselves or another a proprietary right or claim manifestly disproportionate to the consideration: 1–5 years’ imprisonment. Inducing intoxication with alcohol or psychoactive substances to obtain consent to transfer or relinquish a right, where loss results, carries 2–7 years. Not every gift by an elderly person or disadvantageous act automatically falls under Article 247. A lawyer can identify the form alleged and evidence for each condition.

The victim’s vulnerability and defence strategies

The defence examines the lending relationship, obvious vulnerability and disproportion of the right obtained under paragraph (1), and induced intoxication, purpose and loss under paragraph (2). Capacity to understand is not the only condition: a person may retain capacity yet have relevant vulnerability. We analyse contracts, actual consideration, medical documents and communications. Notarisation or expressed consent does not alone exclude exploitation, but age does not automatically prove it either. We can request expert assessments and valuations, contest unfounded presumptions and separate possible civil issues affecting the act from the conditions of the criminal offence.
