Assault or other acts of violence

Legal defence in cases of assault or other acts of violence

The offence of assault or other acts of violence (Article 193 of the Criminal Code) concerns striking or violence causing physical suffering, punishable by 6 months–3 years’ imprisonment or a fine. If injuries or impairment of health requiring no more than 90 days of medical care are caused, the penalty is 1–5 years’ imprisonment or a fine. The limits increase by one third in the situations under paragraph (2¹), including a child victim, an act committed in public, a victim in the perpetrator’s care or carrying the dangerous objects or means listed by law. Domestic violence and the circumstances under Article 195¹ require separate analysis. The correct classification, medical records and circumstances of the conflict should be checked before the first statement.

Prior complaints, withdrawal and defence strategies

As a rule, criminal proceedings begin on a prior complaint by the victim, but the law permits or requires prosecution ex officio in certain situations. Withdrawal of the complaint is not the same as reconciliation: for Article 193, reconciliation is not a statutory ground for extinguishing criminal liability. Withdrawal may occur until the final judgment but takes effect only if endorsed by the prosecutor; for an act against a family member, it does not produce the effects under Article 158(1). We can check the applicable regime, negotiate reparation and challenge forensic medical conclusions where grounds exist. Self-defence is considered separately from provocation, which is a mitigating circumstance. Strategy depends on evidence, not merely a subsequent agreement between the parties.
