Bodily injury

Legal defence in bodily injury cases

The offence of bodily injury (Article 194 of the Criminal Code) is a serious assault on a person’s physical integrity or health. The offence applies where traumatic injuries or harm to health cause any of the following: disability, serious and permanent disfigurement, miscarriage, danger to life, or injuries requiring more than 90 days of medical care to heal. Given the seriousness of these consequences, criminal law imposes substantial prison terms of 2–7 years, while acts committed with the purpose of causing disability, injuries requiring over 90 days of care or serious permanent disfigurement are punishable by 3–10 years. Under paragraph (2¹), the limits increase by one third. Early legal assistance is recommended; whether it is mandatory is assessed under Article 90 of the Code of Criminal Procedure.

Analysis of forensic medical reports and defence strategies

The central element of defence in a bodily injury case is critical analysis and challenge of the forensic medical expert report, which determines the legal classification. Unlike assault, bodily injury is prosecuted ex officio, and reconciliation between the parties does not remove criminal liability. The legal strategy therefore focuses on contesting the seriousness criteria, such as the permanence of disfigurement or whether life was genuinely endangered, or proving grounds of justification or exclusion of culpability, such as self-defence or non-culpable excessive self-defence. Provocation is assessed separately as a mitigating circumstance, not a justification. These distinctions can support an application for acquittal or, as appropriate, a reduced sentence.
