A visa refusal is examined in relation to Government Emergency Ordinance No. 194/2002 and, for short-stay visas, the EU Visa Code. Visas are issued by Romania’s diplomatic missions and consular offices; IGI has an endorsement or approval role in the cases provided by law, which must not be confused with issuing the visa. Refusal of a type C visa may rest on different grounds from refusal of a type D long-stay visa. The procedure stated in the decision must be checked immediately; in administrative litigation, a prior administrative complaint is generally filed within 30 days of service, subject to statutory particularities and exceptions. Incorrect classification of the decision can lead to selection of an inappropriate remedy.

The relief sought — annulment, reassessment or an order to take a specific step — is determined within the law and the evidence, without automatically promising that a visa will be issued.
