Terms and conditions for mobile apps

A mobile app operates in three layers: the user contract, applicable statutory rules and app-store policies. The documents must be consistent with onboarding, permissions, purchases and account deletion.

The user contract

The terms identify the app operator, eligibility, functions, account, user content and acceptable-use rules. For apps intermediating services or third-party sellers, the roles must be explained without concealing who is responsible for the transaction.

The B2C regime requires information, remedies for digital services and rules on withdrawal or termination. The app cannot reduce these rights through a general “as is” clause.

Purchases and subscriptions

Digital purchases are subject to both the law and platform policies. Apple and Google rules change and may differ by territory, app type and alternative billing programmes.

  • The product or feature unlocked and duration of access.
  • The price, taxes and currency displayed to the user.
  • Trials, conversion and automatic renewal.
  • Upgrades, downgrades, cancellation and refunds.
  • The role of Apple, Google or the processor in the transaction.
  • Synchronisation of purchases across devices and platforms.

Data, permissions and SDK providers

The privacy policy must reflect the data actually collected by the app and SDKs: analytics, advertising, crash reporting, location, contacts, camera or identifiers. App Store and Google Play declarations must match the technical reality.

Operating-system permission is not automatically GDPR consent for every purpose. The legal basis, minimisation, retention, recipients and transfers must be analysed separately.

Moderation, suspension and account deletion

If users publish or communicate, the terms must define content rules, reporting, moderation and appeals. For certain intermediary services, the Digital Services Act may add specific obligations.

Suspension must have proportionate grounds and a procedure. Account deletion must align with subscription termination, data export, statutory retention and preservation of evidence relating to fraud or abuse.

Frequently asked questions

Are App Store or Google Play rules sufficient?

No. They govern the distribution relationship, but the app needs its own contract and must comply with the law applicable to users.

Can I use the same policy for the website and app?

Only if it fully describes the data and providers in both environments. Apps often use SDKs and permissions that do not exist on the website.

Must the terms change when store policy changes?

Yes, if the change affects payments, subscriptions, data, moderation or promises made to users. Platform policies must be monitored.
