Cookie policy and consent-banner configuration
The cookie policy explains the technologies used, but compliance depends primarily on the website’s technical behaviour. Non-essential cookies and trackers must not be installed before consent, and the banner must offer a genuine, informed and demonstrable choice.
The technical inventory precedes the legal policy
Scanning must cover multiple pages and scenarios: before and after login, checkout, forms, video, maps and integrations. Some scripts set identifiers through local storage, pixels or similar technologies, even if the traditional cookie list appears short.
For each technology, the provider, purpose, duration, domain, data and transfer are identified. Classification as “necessary” depends on the function requested by the user, not its commercial usefulness to the operator.
The banner must actually control the scripts
The interface and technical mechanism must be tested together. A “Reject” button that hides the banner but leaves analytics active does not respect the user’s choice.
- Initial display: essential information and easily understood choices.
- Rejection: accessible without disproportionate steps or manipulative design.
- Categories: sufficiently granular for different purposes.
- Default state: non-essential trackers disabled before agreement.
- Withdrawal: as simple as giving consent, with a genuine technical effect.
- Evidence: the banner version and choice, without excessive data collection.
The policy, providers and transfers
The policy must describe categories, purposes, durations and third parties in accessible language. Automatically generated lists must be checked because a cookie’s technical name does not explain its purpose and may become outdated after an update.
If the tracker transfers data outside the EEA, the privacy policy and transfer analysis must align. Consent to accessing the terminal does not automatically resolve all GDPR obligations relating to subsequent processing.
Monitoring after publication
Plugins, the tag manager and campaigns introduce new trackers. Periodic scanning and approval of scripts before launch prevent discrepancies between the published policy and actual configuration.
Testing must be repeated across browsers and devices for acceptance, rejection, partial preferences and withdrawal. Logs and policy versions must be retained for as long as justified to demonstrate compliance.
How we work together
- 01Collecting information
We establish the processes, systems, providers, data categories, roles and existing documents relevant to the cookie policy and consent banner.
- 02Risk and legality analysis
We check purposes, legal bases, proportionality, time limits, transfers, security and risks to data subjects.
- 03Documents and workflow
We draft the legal documents and align them with internal responsibilities, technical steps, evidence and response deadlines.
- 04Controlled implementation
We deliver the final version, practical instructions and clear priorities; compliance is reviewed periodically when processes or providers change.
Frequently asked questions
Can Google Analytics start before consent?+
In typical analytics configurations that are not strictly necessary for the requested service, prior consent is required. The precise configuration must be reviewed technically and legally.
Are an Accept button and a Settings button enough?+
Not automatically. The choice must be genuine and easy to exercise; the absence of an accessible rejection option at the first level may cause problems, and scripts must actually be blocked.
Must every cookie be listed?+
Information must be clear and complete about the purpose and technology. A detailed table is useful, but must be maintained and aligned with the actual scan.
