Registering a trademark with OSIM
An OSIM-registered trademark can protect a name, logo or other sign distinguishing a business’s goods and services in Romania. An application’s value depends on prior searches, drafting the goods and services list and the sign’s ability to pass examination, not merely fee payment.
What an OSIM certificate actually protects
Exclusive rights relate to the registered sign and the goods or services listed in the application. A name registered for software does not automatically create a monopoly over every activity using that word. Risk analysis considers signs, goods, the public and likelihood of confusion.
A word mark protects the wording independently of a particular graphic representation, while a figurative or combined mark is tied to the visual elements filed. The choice should reflect intended brand use and the portfolio budget.
Availability searches and Nice classes
A useful search goes beyond exact matches. Earlier marks with phonetic, visual or conceptual similarity and names used for related activities matter.
- The sign: distinctiveness, descriptive elements and possible absolute refusal grounds.
- Earlier rights: OSIM and EUIPO databases and international marks effective in Romania.
- Classes: actual or foreseeable goods and services, described precisely enough.
- Owner: the person or company that should own and exploit the mark.
- Evidence: retaining documents showing genuine use and visual identity changes.
From filing to opposition and registration
The application is examined formally and against statutory grounds. After acceptance and publication, earlier-right holders may oppose within the statutory two-month period. No opposition does not guarantee every future use is risk-free, but permits completion if other conditions are met.
Deadlines and fees must be tracked at each stage. Missing a payment or response can affect the application, and the goods list cannot later be expanded without a new filing.
When a national trademark is appropriate
National filing is often proportionate for a Romania-focused business or initial brand validation. If launch targets several EU states, it should be compared with an EU trademark; for non-EU markets, the Madrid System may be considered.
A sound strategy starts from actual markets, not an abstract desire for global protection. Filing, monitoring, opposition, translation and use costs must be considered together.

Yes, if the sign meets trademark requirements. Registration of a company name in the trade register and trademark registration are different procedures with different effects.

Should the logo also be registered?+
It depends on the visual element’s value and budget. Separate name and logo applications can be useful so graphic changes do not affect name protection.
